Terms of Service

Effective TBD

These terms are an agreement between Trotly ("Trotly", "we", "us") and the restaurant or business that signs up for our service ("you", "the restaurant"). People who place orders on a restaurant's ordering site ("diners") are covered in section 9.

1. What we provide

Trotly builds and hosts online ordering websites for restaurants. Each site shows the restaurant's menu, takes orders for pickup or delivery, and accepts card payments through Stripe. Restaurants see and manage their orders in an online order board and receive new-order alerts by email.

2. Signing up

To use Trotly you must be a business able to enter contracts in Canada, give accurate business details, and complete Stripe's account setup. We may decline or end a sign-up at our discretion before your site goes live.

3. Payments and who the seller is

4. Our fees

5. Cancellations and refunds

6. Your responsibilities

You are responsible for your menu, prices, taxes, food safety, allergen information, permits and licences, preparing and handing over orders, and following the law that applies to your business. You must not use Trotly to sell anything illegal or restricted under Stripe's rules.

7. Your content

You keep ownership of your name, logo, photos and menu. You let us use them to build, host and promote your ordering site (for example, as an example of our work, unless you tell us not to).

8. Availability

We work to keep sites online and fast but cannot promise uninterrupted service. We may change or improve features. We will tell you in advance about changes that materially affect you.

9. Diners

Diners order from the restaurant. Questions about food, orders or refunds go to the restaurant first; we help resolve problems with the website or payments at hello@trotly.ca.

10. Ending the service

You can stop using Trotly at any time by emailing hello@trotly.ca. We can suspend or end the service if you break these terms or Stripe's rules, or with 30 days' notice for any other reason. Orders already paid are still honoured or refunded.

11. Liability

To the extent the law allows, Trotly is provided "as is", and our total liability to you for any claim is limited to the commission you paid us in the 3 months before the claim. We are not liable for lost profits or indirect losses.

12. Changes to these terms

We may update these terms. We'll email you at least 30 days before a material change takes effect.

13. Law

These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there.
